>> right now we are on a live look of the embarcadero. bright, shiny, even before the sun comes up. it is wednesday, november 14. this is "today in the bay." good wednesday morning to you. i'm laura garcia-cannon. >> i'm jon kelley. residents in daly city, residents getting through a big-time mess of mud. lots to be cleaned up after a water main break cause as massive landslide there. clogging streets and cars with several inches of mud and with rain on the way. those cleanup efforts now getting kicked into overdrive. christie smith is live in daly city and she has the latest. she was there yesterday. how do things com look compared to that craziness? >> reporter: good morning to you. you know, i have to say that the streets are cleaned up pretty well where there was mud tall way up to the wheel well of some

tires. we are at the top of the hill. had is actually hillside park. what i want to show you is over here, steve can pan over a little patch of grass. if you can pan over you can see what is left here is mud. that's a result of the slide yesterday. there is concern that rain could cause additional problems over the next couple of days after a mud slide. oar night yesterday. that was caused when a water brain broke sending 45,000 gallons of water, mud and down the hill and right into the neighborhood. forced evacuations. unfortunately it didn't get into any homes. but it did make a mess of cars in the streets here. crews are going to return today to continue all the cleanup and to prepare for the rain coming. neighbors told tuesday initial break sounded like a storm. >> i saw the police out here. and about -- 5:00, i could see the water coming down. fiber glass, the police said --

the water is coming down fast. >> reporter: what will happen is city workers will come back at day break and check and clear the storm drains to make sure that the water has place to drain. the pipe that broke was installed way back in the 1930s. watt prer a water tank above several neighbors i spoke with yesterday who live right in front of it said the tank is up the hill behind them, tell me that they didn't even know it was there. reporting live in daly city, christie smith, "today in the bay." the way hundreds of california businesses operate changes today, state's cap and trade laws take effect despite an 11th hour ho-hour appeal to >> good morning. considering california's green experiment to temper global warming cap and trade will important more than 400 industrial companies in california to reduce their carbon pollution or by so-called

carbon credits at auction. it is the centerpiece in the 2006 state law designed to reduce greenhouse gases to 1990s levels by 2020. california air resources board has been looking forward to this day for a long time now. board will run today's first ever auction and with cement manufacturers, oil refineries, those sorts of greenhouse gas emitting companies will bid on these pollution permits. one permit allows one ton of carbon to be emit. minimum bid price of $10 a ton. many businesses say that is merely an energy tax that will cost them a fortune while others, including pg&e support the move but warn it is going to impact rates. >> i think all eyes are on california now to see the outcome of this. that's why we want this program to be successful and pg&e has been at the table and part of the stakeholder process to ensure that this program is successful and we can, again, manage those costs for our customers. >> the single caveat is there is

a chance today's auction will be blocked by a lawsuit filed in sacramento just yesterday on behalf of the california chamber of commerce. the chamber says the air resources board does not have the authority to sell the emissions allowed to the highest bidder. the board says that yes, it does. the auction is going to happen. we will know by 10:00 this morning when the bid sing scheduled to start. >> marla, thank you very much. a suspected serial rapist set to appear in a san jose courtroom this morning. he stance accused of rape, kidnapping, attempted robbery. police say that he raped one woman and then tried to rape another one just last month. he is expected to enter a plea this morning. rios remains on probation for felony hit-and-run. one of the men arrested in connection with vandalizing a bus the night the giants won the world series is due in court this afternoon. police say that this photo shows 24-year-old adam diaz using a

skateboard to smash the side windows of the $700,000 bus. third suspect arrested in connection with the destruction back in october 29. diaz was booked into the san francisco county jail on friday on suspicion of vandalism and damaging a transit vehicle. both of which are felonies. happening now, gearing up for crab season. fishermen hitting the water this morning to drop their pots. commercial season officially opening up tomorrow from half moon bay to bodega bay which means the bay area will soon be enjoying a lot of fresh local crab. bob redell is live in san francisco with more for us on the ongoing with the crab catches. bob, good morning. >> reporter: good morning to you. we are live here at pier 45. we just got done speaking with a couple of crab fishermen, captains of the boats. boats are, as we speak, heading out to the golden gate to go set their traps. pots you are looking at now in front of you.

then what they will do is come back today and go back out there tomorrow to pull the pots and see what they caught inside. this is -- the information that they are -- receiving right now from other fishermen out there. the sport fishermen, they are hearing that -- in terms of quantity, there is not going to be as much crab out there this year as there was last year. the good news is that they are going to have this crab in in time for thanksgiving. you may recall that was not the case last year because of price disputes. there wasn't crab until after thanksgiving and anyone who lived in the bay area knows that crab for thanksgiving is quite a tradition around here. that's the good news. bad news is you are going to be paying a little bit more. last year 2.25 per pound. because of the limited supply, you know, supply and demand this year, the processors and the fishermen agreed on $3 a pound which means you will be pay being 75 cents more. >> god willing, we should be able to fill all of those crab borders for thanksgiving. we will -- it will not abcheap price this year.

everyone needs to expect a higher price. >> also, factoring into the higher price is the cost of fuel. that's another reason why the price might be a little bit higher compared to last year per pound. they are going to be bringing the crabs back in tomorrow so they should be on the market late tomorrow morning, afternoon if you want to get down here to fisherman's wharf. reporting live at fisherman's wharf, bob redell, "today in the bay." >> thank you very much. our resident longshoreman out there. check the forecast now with meteorologist christina loren. another warmup on the way. >> yes. we have a lot of rain just around the corner. you want to take advantage of it. if you can. good morning to you. thanks for waking up with us. 56 degrees to start you out in san francisco. 41 in napa. taking you down to the south bay, temperatures are comfortable. 44 in livermore. lot of mixing in our atmosphere. that's the reason why from offshore winds. very close to temperature

records as we head throughout the day today especially in oakland. 74 degrees today and tomorrow. and that will tie a temperature record if we hit that. so we are expecting pretty warm weather for this time of year. 74 in livermore. 72 in fremont. and 71 degrees in san francisco. if you have the day off, santa cruz is looking fantastic, 73 degrees. rain arrives in less than 24 hours. we are going to talk about where we are going to get the first showers and who is going to get the most. we have a lot of rain on the way. at least five to six consecutive day was rain in the forecast. stay tuned for that. definitely want to keep that in mind as you try to make your holiday plans. check on your drive right now. we had a holiday at the start of the week. hey, traffic. it was fully in effect yesterday, mike. >> yes. little bit lighter in many spots. yes, really big problem like oakland and portions of san jose. we will track those again today. wednesday, we will lack at the bay bridge. what we did have disabled vehicle reported across that span. you know, okay at the incline.

map will show there is a slowing on the sensors. we did have the report of the stall cleared from the bridge a few minutes ago. we also have over on the shoulder, eastbound 24 just past the tunnel, still activity from materialier car fire. sounds like there is no hill fire and basically we are just trying to get another update completely removed from the roadway. lanes, moving smoothly. another look outside. shaping up in the south bay. san jose is fine. wider view. give you a little notice getting off the freeway where you can't get off there. >> thanks so much. frequent fliers passing through sfo have a new way to speed through security. starting today, the tsa is adding a pre-check travel lane at the busy bay area airport. selected passengers will no longer have to remove their shoes, belts, coats, take their laptops out of the bag to be screened separately. right now pre-check is only available to select frequent fliers from a small list of airlines. airlines chooses participants

welcome back. good morning. governor jerry brown in san francisco today attending a meeting of the u.c. board of regents. this is his second straight day of board meetings. one thing not on that agenda, increased fee force students in professional degree programs. governor brown right now is asking the board to delay that issue to allow more time to look

into the policies behind the idea. that request coming after the csu board of trustees decides to postpone a vote on a new undergraduate fee structure. governor brown attending yesterday's meeting in long beach and says that he agrees with the board's decision. he also discussed the passage of prop 30 saying it will greatly help public schools and universities but keep in mind that it will not fix everything. 5:13. man on the run. john mcafee say he narrowly escaped the police dragnet in belize. he is wanted for questioning for the murder. >> we were discussing that yesterday. person of interest in his adopted homeland of belize. mcafee has been talked to a reporter and says he's changed his appearance and at one point dug a hole in the sand. crouched down inside with a cardboard box over his head. this according to phone calls from the eccentric millionaire

who founded mcafee virus. he is wanted for the murder of his anybody or. cisco systems says he had nothing to do with the u.s. government's scathing report of a competitor. cisco's ceo john chambers talking with reporters and analysts on the conference call tuesday afternoon a at cisco systems reported quarterly profits. cisco competes with chinese company -- both make networking equipment that makes the internet go. the house intelligence committee labeled as unsafe to use. citing concerns over chinese spying. a sign of the times chip maker amd reportedly looking to sell itself to highest bidder. chip companies may put the word silicon in silicon valley but have struggled lately as the world has turned away from traditional computers towards mobile devices. amd and cross town rival intel have had trouble making that

pivot. amd have had layoffs lately as well. >> all right. thank you very much. not an official holiday but a day of celebration for skiers and snowboarders. tahoe area resorts starting their season today. s north store opens today. kirkwood and squaw valley will open on friday. mt. rose in sierra at tahoe will open next week. they are going to get -- we are going to get another storm from it. more snow. >> two more storms coming through. >> yeah, yeah. we have a lot of rain. you are talking snow in that on show. that means rain in the bay area. and potentially an inch and a half of new rainfall along the peninsula. yes, this is no joke. 56 degrees in san francisco. 41 in napa. and sonoma, 49 degrees. it is not as frigid as it has been. heading towards a really comfortable afternoon with near record warmth as high pressure moves in and drives our winds offshore for the second consecutive day. sunny conditions, plenty of 70s.

in fact, there's not a temperature on my forecast map today that isn't in the 70s. stay tuned for that. let's talk about the rainfall. we stopped the clock for you at 3:00 a.m. on friday morning. that's when the heaviest rains start to come through. look at this. we are talking about sloppy commutes on friday morning with light to moderate showers. all the way from the north bay up and down the peninsula into the east and south bay as well. we are get another round of rain late friday, saturday, and embedded within that rain you see orange and yellow, that's heavy rainfall from time to time as we head lou provide and early saturday. then colder system moves through as we head lou the second half of your sunday, monday, and lingering showers expected on tuesday as well. so the moral of this story is enjoy the warmth and sunny weather while it lasts. two more days. 72 in fremont and 71 degrees in san francisco. it is not going to get all of that cold around here. we are going to hold on to the 60s more or less. we are talking about a lot of rain. all the way through the upcoming

because of construction. you will lose a lane or two. just for the time being. here is a light volume that does not cause -- head north from the san mateo bridge up into the city. south bay, a look. here westbound 80. that's southbound on the map. that's your commute direction for underneath university avenue overcrossing. nice space. still at the limit. 18 minutes from t. approaching northbound. no problems. from move at owe down lou san ravel atraffi rafael. family of a young girl hit and killed riding her bike home from school in novato filed a lawsuit against the city. 12-year-old halle ratliff family suing the city for what they are calling, quote, dangerous condition of public property. the lawsuit claims residents had raised serious safety concerns about the area of novato boulevard where the 7th grader was struck by an suv and in late september.

she sadly and tragically died shortly after the crash. this lawsuit says that the speed limit sign is there. remains obscured by overgrown trees and there is no cross walk in the area where the girl was hit. the city of oakland is paying out millions to settle lawsuits over illegal strip searches. council members voted yesterday to pay nearly $5 million to 39 men who alleged police pulled their pants down on city streets. the incidents happened during a seven-year stretch between 2002 and 2009. settlement comes more than a year after a federal judge ruled oakland's strip searches were unconstitutional. it is 5:19 now. california's national guard had a long history of helping escape a nation during tough times. joynl investigation by nbc bay area and knbc tv in los angeles uncovers a disturbing hidden culture in the california guard where some say sexual assault and racism at times goes

unchecked. we spoke with nearly would dozen men and women from the california national guard. they tell us the current culture is toxic. now they want to expose what they say is the truth. >> i want it to stop. >> reporter: she is a master sergeant serving in the guard for a dozen years. >> i don't understand. i had -- >> reporter: she is a staff sergeant serving in the military for would decades. they are part of the 23,000 men and women serving the california national guard. where it is integrity first and service before self. and just some of the members who say that for years they have witnessed sexual harassment, racism, and retaliation. >> is that part of the culture, national guard? >> yes. absolutely. >> what's the current reputation

of the california national guard? >> totally different. it is not a good reputation. it is -- it is not. >> reporter: chief warrant officer pet jay decorate member of the oklahoma national guard. last year he was one of two independent investigators. sent to california to investigate problems. >> reading from your report, sexual harassment and hostile work environmentment is commonplace in the california national guard. >> that's what we got from everybody we talked to. that was commonplace. >> reporter: we obtain ad copy of the report and we will bring you the results in our full investigation tonight at 11:00. how does the major general of the guard respond to the cultural problems addressed in that report? well, so far, multiple requests to interview the commanding officer of the guard have all been denied. coming up tonight at 11:00, you will also hear more from the men and women who say the guard let them down. and are now demanding change in

police in the east bay area trying to track down a piece of california history at the museum. directors of the museum won't say exactly what was taken. only that it is a great historic importance. security tapes show a man entering through the second floor and breaking through several plexiglas dismay cases. he knew what he was looking for and got it. the gallery house was -- native american art pacts and mining equipment from the gold rush. it is a very special day for

icons. former nfl quarterback steve bartowski, brandi chastain, roger maltbie and willie t.ribbs will be induct flood the san jose hall of fame today. special ceremony taking place at the pa i will have wron and kicks off with a dinner and reception followed by the induction ceremony where each athlete will be recognized with a bronze plaque installed on the course level of the pavilion. a total of 85 athletes will be enshrined in that hall of fame after tonight's induction. the event will honor some younger athletes making an impact in their particular sport. here is a few familiar names. andrew luck, marty malloy. they did quite well for

find. >> right now we have a live look over san francisco. yes. we are moving one day closer to the weekend. it is wednesday. november 14. this is "today in the bay." it is 5:30. good morning. happy you could join us. i'm jon kelley. >> i'm laura garcia-cannon. new details this morning in the disappearance of sierra lamar. new charges have been filed against the prime suspect in custody for the 15-year-old's kidnapping and murder marla tellez joins us with more. >> reporter: >> it is hard to believe that just two days from now will mark eight months since morgan him teenager sierra lamar disappeared. now we have just confirmed the santa clara county district attorney has added three charges against garcia-torres who is already facing murder charges

for lamar's death. although her body has not been found. these new charges are not related to the lamar case. let's be clear. they have you lee counts of attempted kidnapping in the commission of a carjacking. according to the d.a. they involve three separate victims. at least would of whom were young women. all lee incidents happened back in march of 2009. these new charges will be filed as adult charge, even though at the time of the alleged attacks, torres was a minor. our chief investigative reporter to tony kovaleski has more. >> the evidence and new charges bolster the d.a.'s theory garcia-torres is a violent predator capable of murder. >> conduct we believe we can prove beyond a reasonable doubt to hold the defendant accountable important everything that he has done. >> reporter: torres was arrested may 21 in connection to the

disappearance of 15-year-old sierra lamar. his next court date is december 10 when he will likely be rained on the three new charges. >> thank you very much. a school board meeting again this morning behind closed doors. talking about ways to keep students safe. the board meeting last nature for the first time since they sex abuse scandal forced the board's president to resign. in that meeting the board apologizing to former students christine kunane and two others sexually abused victims. this night they are pledging to make changes in hoping to protect the students. >> i can't tell you how sorry we are. >> nothing that my brother or any of kristin's family can do to take away the pain but i will guarantee you what they will do. they will do anything given your power to make sure that that doesn't happen again. >> the board also announcing all lee victims now agreeing to mediation was hopes of reaching

a fair resolution. 5:33. detectives need your help to find a man behind a brazen and bizarre kidnapping. police want you to take a good luc at the surveillance photos after man that goes by the name of aubry. he and a second man who goes by the name david are accused of kidnapping and carjacking 57-year-old woman from outside of the work last wednesday. she was tied up and blindfolded and forced to withdraw money from a number of atms. they then drove her to an isolated area of the oakland hills and let her go. new this morning, highway 101 back open after an overnight crash that closed all southbound lanes in san martin. chp says a dump truck crashed ask spilled a load of dirt in the air and san martin avenue. that crash ultimately shut down all southbound lanes for hours. crews there had to tow that truck away and clean up all of the dirt left behind before drivers were actually allowed back on the freeway. the chp is investigating the cause of the crash, no word yet

if that driver will be facing any charges. san francisco's city hall is expected to reopen this morning after an electrical pyre late last night. firefighters say the electrical panel started smoking activating sprinkler system in the basement. had is actual cell phone video taken by one of the producers showing water damage. you can see there inside. building not evacuated but power was cut to in of the exterior lights. including the dome on city hall. pg&e crews were on the scene last might. we will know later today what damage was caused by the incident. the water has stopped but mud still covering the streets in daly city's neighborhood this morning. and now there is concern we can -- weekend rain storms can make it worse. christie smith has been following the story since it broke yesterday. she has been on scene and, christie, forecast right now is making that cleanup effort, hearing much more urgent at this hour. >> reporter: absolutely. i have to say, though, the streets are looking good up here yesterday when we -- today.

when we came yesterday we cooperate even drive on them. they were packed with three feet of mud. hillside park. slide area is actually behind these trees here. you can see if you look down at my pete actually, believe it or not, grassy part. i wanted to show you what it is looking like this morning when you walk over and -- head out. it is basic lynn behind tape this morning because the entire thing is still packed with mud. in some places you stand and you just completely sink. and so the concern is that you have this exposed hillside. lot more rain coming in the next couple of days. what will happen next. we spoke with the neighbors about it. they had a little bit of concern yesterday going into this. but, of course, this all started overnight yesterday when a water pipe broke and that sent 45,000 gallons of water barrelling down the hillside and into the street. packed cars with mud, all the way up to their wheel wells, and forced evacuations. fortunately, though, the mud didn't get into homes. but i did speak with one man yesterday. he said it kind of sounded like a storm but really didn't know

where it was all coming from. >> i checked out the side and i saw like some gushing water but i couldn't really see where the source was. >> reporter: did you know there was a water tank at the top of the hill? >> no. i was than really aware there was a tank up there. >> reporter: pipe was actually installed way back in the 1930s. a gentleman from the water department i spoke with that as far as he knew it was just old. and that may have been one of the reasons why it broke. and it connects to a large water tank up above and engineers were on the hillside yesterday checking its stability. again, i-wanted to show you while we are back here live what this park looks like. this goes down at least half a block. you can see this pole here. that's about three feet tall. you can see it is half covered in mud. again, the park is all behind tape this morning. whole thing looking this way. that's the latest from here reporting live in daly city. christie smith, "today in the bay." >> thank you very much. we have to pitch in and buy her

new shoes. >> she has the boots today. it is a good plan to enjoy the warmer weather today. more rain is on the way. >> yeah. we have a lot of rain on the way. good morning to you. want to start with this live beautiful shot over the bay bridge this morning. clear conditions in san francisco. we will hit the 70s in the city by the bay today. the crisp to start but not as frigid. temperatures in the 40s and 50s. good morning to you in san francisco. right here in san jose we are at 45 degrees. 40 in gilroy. your temperatures have crept up over the past couple of mornings. we have been in the low to mid 30s. as we head throughout the day today, high pressure drives those winds offshore. for us that's going to make for really comfortable beach conditions. if you have the luxury to hit the beach maybe a family in town early for the holidays. 74 for livermore. 71 degrees in fairfield. and 70 in concord. i will have your 7-day outlook starting to get the first showers as of tomorrow night. stay tuned for that.

five consecutive days of rain in the forecast. but you will have opportunities to get outdoors. time that out coming up. we want to take a look at your wednesday morning drive. good morning, mike. >> good morning. look at this. camera over at free monday. right by it. you can watch as the colors change. i will tell you there was a good slowdown here. going from blue over towar towards ---er blue now. southbound side with the headlights, they have a good deal of slowing. big burst of traffic. we will take you to the map and had both directions slowing the area that i have circled just north of michigan. now there were reports of a disabled vehicle just south of here. there may have been a traffic -- starting there to 880 and 237. in the last five minutes, it happened and cleared. better news now. south of it, volume starts to build for 101. see that first building, show you how that plays out for san jose in the next report. i want to give you a quick check of san mateo bridge. burst of traffic heading over to 9 the as well. westbound with tail lights moving slowly. it is 5:39 right now. latest on the investigation
